Situation 1
A lady intends Hajj-e-Tamat’tu and
she is outside the Meeqaat, (e.g. in Madinah). Just prior to
departing for Makkah, (and with many days left before the 8th
of Zil Hajj), she starts her menses. What should she do?
She should take a bath if possible
and put on her Ihraam by making intention and reciting the
Talbiyyah. This bath is Mustahab for anyone putting on Ihraam. (All
the restrictions of Ihraam will now apply to her). Thereafter she
should proceed to Makkahtul Mukarramah. In Makkah, she will remain
in the state of Ihraam until her menses cease. When her menses
terminate, she should make ghusl to become Paak and perform the
Umrah. After the Umrah she will come out of Ihraam by clipping her
hair. Thereafter, Hajj will be performed as normal.
Situation 2
A lady intends Hajj-e-Qiraan and
she is outside the Meeqaat, (e.g. in Madinah). Just prior to
departing for Makkah, (and with many days left before the 8th
of Zil Hajj), she starts her menses. What should she do?
Same as Situation 1 above, except
that she won’t come out of Ihraam after her Umrah, i.e. she will not
clip her hair. She will only come out of Ihraam after Hajj.
Situation 3
A lady intends Hajj-e-Tamat’tu, is
not yet in Ihraam, and starts her menses on the 8th of
Zil Hajj, prior to reaching the Meeqaat. What should she do?
She should not make
Hajj-e-Tamat’tu but instead make Hajj-e-Ifraad, since seeing that it
will be impossible for her to make Umrah before the Hajj rites
commence. She should proceed straight to Mina and perform the Hajj.
In this case the obligatory animal sacrifice, (Damm-e Shukr), is not
Waajeeb on her.
If in this case her group decides
to go to Makkah to perform Umrah or Tawaaful Qudoom despite the time
factor, she should wait for them in Makkah without performing any
rite or entering the Masjid. She will then continue with her group
to perform all the rites of Hajj, (except for Salaat), and trim her
hair after pelting the Jamaraat Aqabah, (Big Shaitaan), on the 10th
of Zil Hajj. She will now be out of the state of Ihraam except for
sexual relations. Once her menses have ended she will have a Ghusl,
will renew her Ihraam and perform Tawaaf-e-Ziyyaarat (=Tawaaful
Ifaadhah) and the Sa’ee of Hajj. All the restrictions of Ihraam
will now be lifted.
Situation 4
A lady intends Hajj-e-Ifraad, is
not yet in Ihraam, and starts her menses on the 8th of
Zil Hajj, prior to reaching the Meeqaat. What should she do?
She should don her Ihraam and
proceed straight to Mina for the Hajj. If she is not pure by the 10th
of Zil Hajj, she should wait until she becomes pure and thereafter
perform the Tawaaf-e-Ziyyaarat and the Sa’ee of Hajj.
Situation 5
A lady intends Hajj-e-Tamat’tu, is
already in Ihraam, but before starting or completing her Umrah her
menstruation starts and it happens to be the 8th of Zil
Hajj. What should she do?
If she has completed four or more
rounds of the Tawaaf of Umrah then this Tawaaf is regarded as
complete. She should give Sadaqah, (same as Sadaqatul-ul-Fitr), for
each of the incomplete rounds. Thereafter, she can complete the
Sa’ee as well because purity is not a required condition for Sa’ee.
Now her Umrah is complete and she can come out of Ihraam. She can
then perform the Hajj as normal.
If
she has not completed four or more rounds of the Tawaaf of Umrah,
then her Tawaaf will be incomplete. She should break her ‘Umrah by
trimming and combing her hair with the intention of becoming
Halaal. Thereafter, she should make the intention of Hajj-e-Ifraad
and perform Hajj. Once she has completed all the rituals of Hajj
and has become pure, she should perform Tawaaf-e-Ziyyaarat and the
Sa’ee of Hajj. She should then perform the Qadhaa of the annulled
‘Umrah and offer a Damm of one goat / sheep or one seventh of a
camel.
Situation 6
A lady has completed her Umrah and
is now in Makkah waiting for the 8th of Zil Hajj.
Before, or on the 8th of Zil Hajj, her menstruation
starts or is not yet over. What should she do?
She should don the Ihraam of Hajj
and perform all the rites of Hajj. If she is not pure by the 10th
of Zil Hajj, she should wait until she becomes pure and thereafter
perform the Tawaaf-e-Ziyyaarat. and Sa’ee of Hajj.
Situation 7
A lady has a regular menstrual
cycle which commences on the 10th of every Islamic
month. She is performing Hajj and today is the 9th of
Zil Hajj and her menses are due anytime. In addition, her departure
from Makkah is soon after Hajj and there is no possibility
whatsoever of delaying her departure. What should she do?
If this was not catered for in
advance, and she did not have the time to perform the
Tawaaf-e-Ziyyaarat, then, in spite of efforts in re-adjusting
her bookings, there is no possibility of delaying her departure,
then there will be permission to use temporary medication,
(contraceptive tablets), to stop the bleeding as a last resort.
However, such a woman will have to be prepared for the side-effects
in this regard as there is a fear of an adverse effect on her health
and monthly cycle. That is why as far as possible these types of
medication should not be used except due to a dire need.

Yet other jurists have given a
ruling that such a lady can perform her
Tawaaf-e-Ziyyaarat in this state
of impurity but she will be liable for a Budnah i.e. the
slaughtering of one camel/cow/ox within the precincts of the Haram
boundary.
Situation 8
A lady is performing Hajj; today
is the 9th of Zil Hajj and her regular menses of seven
days has commenced. In addition, her departure from Makkah is soon
after Hajj and there is no possibility whatsoever of delaying her
departure. What should she do?
Same as Situation 7 above.
Situation 9
A lady intends Hajj-e-Tamat’tu and
starts her regular menses on the 7th of Zil Hajj while
performing her Tawaaf for Umrah. What should she do?
Same as situation 5 above.
Situation 10
A lady commences her menses while
performing Tawaaf-e-Ziyyaarat on the 10th of Zil Hajj.
Her habit is for 10 days and 10 nights. In addition, her departure
from Makkah is soon after Hajj and there is no possibility
whatsoever of delaying her departure. What should she do?
Same as No. 7 above.
Situation 11
A lady commences her regular
menses while performing her Tawaaf-e-Wida. In addition, her
departure from Makkah is very early and there is no possibility
whatsoever of delaying her departure. What should she do?
The Tawaaf-e-Wida drops off due to
her menses. She can leave Makkah without performing it. She will
not be liable for a Damm.
Situation 12
A lady intends Hajj-e-Tamat’tu and
commences her regular menses while performing her Sa’ee for Umrah.
What should she do?
She can complete her Sa’ee because
purity is not a required condition for Sa’ee.
Situation 13
A lady commences her regular
menses while performing her Sa’ee for Hajj. What should she do?
She should complete the Sa’ee and
her other Hajj rites as normal.
