CONTRAVENTION

(JINAAYAAT)

PENALTY

(JAZAA)

a.

To cut grass or a tree not owned by someone.

Give in charity the value of the vegetation cut.

b.

To cut grass or a tree owned by someone.

Give in charity one value of the vegetation cut and another one value to the owner.

c.

To cut grass or a tree planted by someone but not owned by him.

Give the planter the value of the vegetation cut.

Note

1.     There are four types of trees and grass in the Haram:

 

         a.     Those which people generally sow, (e.g. wheat or barley).

         b.     That which is sown, but not commonly known, (e.g. salvadora, persica, peelu etc.).

         c.     That which grows on its own and is of such a type that people sow.

         d.     That which grows by itself and people generally do not know, (e.g. acacia, etc.).

 

        From these four types, the first three types are permissible; i.e. one may pluck it, cut it or buy it for use.          It is prohibited for a Muhrim or non-Muhrim to cut or pull out the fourth type of plant, irrespective of

         whether one owns the land on which it grows, or not. 

 

2.     On carrying out the penalty, one becomes the owner of the grass or wood, but to sell it is Makrooh-e-

         Tahrimi.  If sold, the proceeds should then be given away in charity.

 

3.     It is not permissible to make Miswaak from the “wet” trees growing within the Haram boundary.

 

4.     It is permissible to cut the “dry” trees growing within the Haram boundary.

 

5.     It is not permissible to allow animals to graze on the grass growing within the Haram boundary.
