Introduction to Jinaayaat & Jazaa

Head/Face Covering

 

 

CONTRAVENTION

(JINAAYAAT)

PENALTY (JAZAA)

a.

For a male to cover his head or face with the above mentioned items for 12 hours or more.

Damm

b.

For a male to cover his head or face with the above mentioned items for less than 12 hours.

Complete Sadaqah

c.

For a female to cover her face touching with the above mentioned items for 12 hours or more, without a valid Shar’ee reason.

Damm

d.

For a female to cover her face touching with the above mentioned items for less than 12 hours, without a valid Shar’ee reason.

Complete Sadaqah

e.

Without a valid Shar’ee reason, for one Muhrim to cover the head or face of another Muhrim who is asleep.

Damm on the "coverer"

f.

For the head or face to become covered accidentally while asleep.

Complete Sadaqah

Note

1.     This same rule applies when a quarter of the face or a quarter of the head covered.

 

2.     If a female uncovers her head then no Jazaa becomes Waajeeb on her.

 

3.     A female should cover her face with a cloth in such a way that it does not touch her face and this is

         applicable when she fears Fitnah.

 

4.     If the head or face is covered during sleep or while awake and such is done willingly or under duress with

         or without a valid Shar'ee reason, then under all these circumstances Damm becomes Waajeeb.

 

5.     If the head or face is covered with something which is usually not used for this purpose, (e.g. a cup, plate,

         etc.), then no penalty becomes Waajeeb, whether the whole, (or less than the whole), of the head or face

         was covered.

 

6.     By using an umbrella, no penalty becomes Waajeeb, as it is Jaiz to do so in the state of Ihraam.
